Planning Board lawsuit: Attorneys' fees

To all of you who worried about the amount of attorneys' fees to be paid. Have no fear.

The Mayor has directed the CFO (Memo of 1/2/03) NOT TO PAY attorney Doug Doyle's bill that was voted on TO BE PAID at the Mayor and Council meeting on Monday, December 30, 2002. He states that he thinks that the Council may have done something "illegal".

Let's see: We met at a meeting that was publicly advertised as per the Sunshine Law. There was a quorum of the Mayor and Council present. The bill was on the agenda on the bill list. We voted in open public session as per the Sunshine Law. The majority of the Council voted to pay the bill. Yep. That certainly sounds "illegal" to me.

Just so everyone knows, there is also Resolution 03-033 (I don't know who prepared this one: Boggia, Regan?) on the agenda for tonight's meeting to fire Doug Doyle and hire Attorney Regan "… for the purpose of bringing this litigation to an amicable conclusion." That should not be hard since Attorney Regan is quoted in the Bergen News (12/18/02) as saying, "I would not want to defend this ordinance in court." So why are we asking him to???

FYI: Robert T. Regan - Borough Attorney - $150.00/hr

Philip Boggia - Planning Bd. Atty. - $135.00/hr

Doug Doyle - Council Attorney - $125.00/hr.

Sounds like a bargain to me.
